They are in the Ubuntu maintained 3.5-stable branch, so I expect the
next 3.5 Ubuntu kernel will include them (if not already released?):

I have no idea what their plans are, but I would be surprised if they
didn't pick these for v3.8 also. The patches were added to v3.9 at a
very late stage and forwarded to stable by davem, so they should
definitely be on the radar of any stable kernel maintainer.

You could open an Ubuntu bug and ask for these in v3.8, I guess.
