They are!

All the cool Winmodems (read: Smartlink) have a freely distributable
ASLA module (that is shipped with the kernel), and a userspace driver
that connects to that ALSA module and emulates a serial port. That
userspace driver can then be easily distributed in Debian Non-Free (or
equivalent) and pretty much seems to rock.
